Description/Background:

On behalf of Sandy City, the Community Development Department is proposing to amend Title 21, Land Development Code, Chapter 11, Special Use Standards, and Chapter 5, Home Occupations. The purpose of the code amendments is to clarify the land uses and activities that are allowed as Home Occupations.

 

The Home Occupation requirements provide an opportunity for residents to conduct home businesses as an accessory use when they are compatible with the neighborhood. Through on-going administration of the home occupation code, staff have identified issues that need clarification or refinement. To address these issues, amendments were presented to the Planning Commission as outlined in the staff report and shown in Exhibit “A” (red-lined version) and Exhibit “B” (clean version). Please see the attached staff report and exhibits for the full details of this item.

 

On March 7, 2024, the Planning Commission recommended the City Council adopt the proposed amendments to Title 21, of the Land Development Code, relating to Home Occupations with a modification to the Section on "Adult Day Care," by excluding individuals that are eligible to receive DSPD services who are adjudicated sex offenders.

 

To address the Planning Commission's motion, the code is revised from those who are "eligible to receive services" from the Utah Department of Health and Human Services (DHHS) Division of Services for People with Disabilities (DSPD), to those who have an "intellectual or physical disability or acquired brain injury, as defined by" the DHHS DSPD.
