Description/Background:

Joe Salisbury, on behalf of DAI (Applicant), has submitted an application for a zone change of approximately 10.07 acres located at approximately 11228 S. 700 E.  The proposed zone change would change the subject property from the R-1-40A Zone "Single Family Residential District" to the PUD(12) Zone "Planned Unit Development (12 units per acre)." 

The Applicant's proposal, depicted in a concept plan, included 116 town home units, approximately 11.5 units.  The proposal was presented in a neighborhood meeting held on May 18, 2020 and to the Planning Commission in a public hearing on June 4, 2020.  The Planning Commission, by a vote of 6-1, forwarded a recommendation to the City Council to not approve the Application.  Following the Planning Commission hearing, the Applicant requested a delay before taking the item forward to City Council in order to make revisions to the concept plan to address input received.  In early September, the Applicant notified staff that they are ready to move forward.  The Application was then scheduled to be presented to City Council.  It is staff's understanding that a revised concept plan, depicting a lower density, will be presented to the City Council.

Fiscal Impact:

The proposed project would likely increase the revenue and expenses of the City by minimal amounts.

Further action to be taken:

The Application is requesting a rezone, a legislative item, and is being presented to the City Council for a decision to approve or deny the proposed zone change.  A separate application for a subdivision or site plan would need to submitted and approved prior to development.
