Description/Background:

The applicant, S. Wade – son currently lives in the property is requesting approval of Category II Home Occupation for a property located at 9470 S. Cobalt Circle. 

 

The applicant is renewing his business license after it has lapsed. He is applying for a Home Occupation II CUP because the business has large vehicles and equipment parked on the property. Three vehicles and a wood chipper are parked on evenings and weekend. There is a small office in the home but no clients visit the office and no business is conducted outside the home. (See exhibit A)

 

Recommended Action and/or Suggested Motion:

Recommendation

Staff recommends that the Planning Commission deny a Conditional Use Permit for Home Occupation II CUP and as described in the staff report for the property located at 9470 S. Cobalt Circle based on the following findings and subject to the following conditions:

 

Findings:

1.                     Applicant is no longer living at the property or running the business.

 

2.                      Currently there are too many business vehicles parked at the property.

 

Conditions:

1.                     The son of the applicant who has moved into the home and taken over the business may apply for a Home Occupation II CUP.

 

2.                     The new applicant will need to provide a letter of acknowledgement and consent of the home owner if renting the home.

 

3.                      Only one vehicle and one trailer may be parked off street at the property.

 

4.                     All excess material or waste materials, such as wood piles, be removed from the property.

 

5.                     Off site employees may come to the property for incidental vehicle stops and must be parked off street.

 

6.                     That the Applicant complies with all Building & Safety, and fire & Life Codes.

 

7.                     That this conditional Use Permit be reviewed upon legitimate complaint.
