Description/Background:
Sandy City, to comply with changes to Utah Code by HB 462, adopted a Moderate Income Housing Element, including implementation strategies and an implementation plan, and submitted the adopted plan to the Utah Department of Workforce Services in 2022. The State reviewed the City's submittal and determined that the City's documents complied with HB 462, however the City was not eligible for priority consideration for certain State transportation funds. According to the State, the City was not eligible for priority consideration due to a lack of detail in the implementation plan for Strategy P (use of RDA moderate income housing set-aside funds). City staff determined to process a General Plan amendment (this item) with the intent to resolve the State's concerns regarding Strategy P in order to be eligible for priority consideration for transportation funds.
Fiscal Impact:
Not being eligible for the priority consideration created by HB 462, could potentially negatively affect City applications for certain State transportation funds.
Further action to be taken:
Following a recommendation by the Planning Commission, the item will be presented to the City Council for review and a final decision. Once approved by the City Council, the amended Moderate Income Housing Element will be submitted to the State.

Staff recommends that the Planning Commission forward a positive recommendation to the City Council to approve an amendment to the Sandy City General Plan, amending the Housing Element and adopting the Moderate Income Housing Element, including the moderate-income housing strategies and implementation plan.
