Description/Background:
Joe Goott (applicant) is requesting a change on one parcel (1.5 acres) located at 2140 E. Creek Road from the R-1-40 Zone ("Single-Family Residential District") to the R-1-15A Zone ("SIngle-Family Residential District" with farm animals permitted). The subject property currently includes an existing home and several accessory structures. The applicant is seeking to establish animal rights on the property and a zone that will allow him to bring existing accessory structures into compliance with the Development Code.
A neighborhood meeting was held on September 9, 2025. The application was presented to the Planning Commission in a public hearing on October 16, 2025. The Planning Commission, by a vote of 5-2, voted to forward a positive recommendation to the City Council. The item was presented to the City Council as an informational item on November 11, 2025.

Fiscal Impact:
It is Staff's opinion that the fiscal impact of the proposed project to the City would be minimal.
Further action to be taken:
The action requested by the Application is a rezone, a legislative item, being presented to the City Council, as the final decision-maker, on November 11, 2025 as an informational item and on November 18, 2025 for action.
