Description/Background:
The City Council heard presentations on the C-PACE program administered by the Governor's Office of Energy Development on April 2 and April 23. The Council directed the City Attorney to review the authorizing resolution and the participation agreement provided by the State of Utah, and prepare them for final adoption. The City Attorney recommends the addition of the following language to Section 2c: OED agrees to indemnify Governing Body from any claims arising out of OED’s violation of this paragraph." The Governor's Office of Energy Development has agreed to this addition.
Fiscal Impact:
There is no fiscal impact to the City as a result of participation in C-PACE.
Further action to be taken:
Staff will provide an executed copy of the documents to the Governor's Office of Energy Development.
