Description/Background:

The applicant, Michelle Martin of Ford & Associates Architects, with permission from the property owners, Clark & Orfalea Investments, LLC, requests approval of a conditional use permit and a modified site plan for a property located at 10291 S. State St. The conditional use permit request is to allow for 24-hour operation of a veterinary office. The modified site plan request is for an outdoor pet relief area at the rear (east side) of the building in the Central Business District (CBD) zone.

Recommended Action and/or Suggested Motion:

Recommendation

Staff recommends that the Planning Commission approve a Conditional use Permit for 24-hour operation for MedVet Emergency Hospital located at 10291 S. State St. based on the following findings and subject to the following conditions:

Findings:

1.                     The proposed use meets the intent of the CBD zone.

2.                     The proposed use should have minimal to no impact on the surrounding uses due to the required mitigation measures.

Conditions:

1.                     That no outside activity between 10 p.m. and 6 a.m. that would create a large amount of noise be allowed (including but not limited to lot sweeping, trash collection, and store deliveries). That each tenant shall restrict employee activity behind the building adjacent to residential property during those hours as well.

2.                     That the applicant be responsible for meeting all provisions of the Sandy City Development Code, and all conditions of approval imposed by the Planning Commission.

3.                     That the applicant complies with all Building & Safety, and Fire & Life Codes.
