Description/Background:
Utah Code requires that cities submit an annual housing report (2023 Moderate Income Housing Annual Subsequent Progress Report). The report documents a city's efforts to implement their selected moderate income housing strategies, the number of accessory dwelling units permitted, and to provide feedback to the State. The 2023 report is the first annual report due following significant legislative changes by HB 462 (2022), HB 364 (2023), and other bills. The 2023 report is required to be submitted by August 1, 2023. The Utah Division of Workforce Services is responsible to provide a template for the report, review reports, issue compliance/non-compliance letters, and process appeals. Cities are required to make "meaningful progress towards" implementation of the required number of strategies.

In 2022, Sandy City adopted the Moderate Income Housing Element as an amendment to the General Plan. The Moderate Income Housing Element identifies six moderate income housing strategies and includes an implementation plan as required by Utah Code.

Sandy City Planning staff, in coordination with other departments, has prepared the 2023 report according to the template provide by the Department of Workforce Services. It is staff's determination that Sandy City has made meaningful progress towards each of the selected strategies over the past year.

Fiscal Impact:
Having and making meaningful progress towards the six selected strategies qualifies Sandy City for priority consideration when applying for certain transportation and transit funding. A determination of non-compliance could impact transportation and transit funding provided to a city. Starting in 2024, cities that are determined to be non-compliant will also be fined. The fine for non-compliance doubles in 2025.
