Description/Background:

Utah State Statute requires that municipal justice courts be recertified by the Utah Judicial Council every four years.  Because certification of the Sandy Justice Court expires on January 31, 2024, they will be submitting an application for recertification. Prior to being able to submit an application the Justice Court must obtain a duly passed resolution from the City Council requesting certification.  The resolution must affirm that the City is willing to meet all requirements for, and operation of, the court during the period of certification.

 

In order to comply with the requirements of the application, the City Attorney's Office has provided a written opinion advising the council of all requirements for the operation of the Justice Court.  The Finance Department has also provided a memo outlining the fiscal feasibility of maintaining the court.

The fiscal impact of the Court can be reviewed in the attached Justice Court Recertification Budget Memo.

 

Further action to be taken:

Should the Council decide to adopt Reolution 23-53C during the December 12, 2023 City Council meeting, then the Justice Court will submit their recertification application to the Utah Judicial Council.
