Description/Background:

On September 11, 2018, City Council passed and approved Ordinance #18-27, An Ordinance Annexing Territory Located at Approximately 2771 East to 3036 East Willow Creek in Salt Lake County, Comprising Approximately 14.9 Acres into Sandy City; Establishing Zoning for the Annexed Properties; Also Providing a Severance and Effective Date for the Annexation. In Section 6, the City Council affirmed that the ordinance “shall become effective upon the later of publication as provided by law or adoption of a Salt Lake County resolution consenting to the annexation.” The Salt Lake County Council currently has the item scheduled for its October 16, 2018, Council meeting. If the resolution of consent is passed, Ordinance #18-27 will become effective. Pursuant to Utah Code Section 67-1a-6.5, however, filing of the notice of impending boundary action and copy of the approved final local entity plat is required within 30 days after enactment of Sandy City’s ordinance. Therefore, staff recommends that Ordinance #18-27 be re-adopted with a new passage and approval date in order to accommodate Salt Lake County’s scheduled meeting such that Salt Lake County’s meeting will fall within that 30-day period.
