On behalf of Sandy City, the Community Development Department is proposing to amend Title 21, Land Development Code, Chapter 30, Subdivision Review, and Chapter 36, Notice Requirements. The purpose of the code amendments are to update the standards for subdivision review procedures to bring the Land Development Code in line with recent changes to the Utah State Code, and to streamline, and clarify subdivision review requirements and procedures. These amendments have been reviewed by the Development Review Team, which is an interdepartmental group consisting of the Community Development, Public Works, Public Utilities, Parks and Recreation, Police, Fire and City Attorney Departments.

During the 2023 Utah Legislative Session, Senate Bill 174 and House Bill 406 were passed, which created new procedures that cities and counties must follow for subdividing residential property. SB 174 requires local governments to update their subdivision ordinance; the deadline for Sandy City is February 1, 2024. SB 406 removes the requirement for a public meeting on property line adjustments. The impetus behind these new state regulations is to facilitate increased housing supply, by creating a uniform subdivision process statewide.

In response to these new procedural requirements for residential subdivisions, Sec. 21-30, Subdivision Review, and Sec. 21-36 Notice Requirements, have been updated to bring the City’s land use code into compliance with the new state law provisions. The proposed amendments also streamline, clarify, and re-organize the subdivision review requirements and procedures, as well as update the public notice requirements for consistency.
