Description/Background:
Robert Herrera, on behalf of Latinos in Action, Inc. (Applicant), has submitted an application for a zone change of two parcels ( approximately 0.55 acres) located at 1200 E. Sanders Road from the R-1-10 Zone ("Single Family Residential District") to the PO Zone ("Professional Office"). The building was formerly owned and operated for seminary instruction by the Church of Jesus Christ of Latter-Day Saints. The Applicant now owns the property and intends to use the existing building for office space. City staff considers the intended land use to be "Professional offices." The City's "Religious or cultural activity" land use is allowed in the R-1-10 Zone. The "Professional offices" land use is not an allowed land use in the R-1-10 Zone.

A neighborhood meeting was held on June 8, 2023. The application was presented in a public hearing to the Planning Commission on July 20, 2023. By a vote a 6-0, the Planning Commission's motion was to forward a negative recommendation to the City Council.

Fiscal Impact:
It is Staff's opinion that the fiscal impact to Sandy City would minimal.

Further action to be taken:
The action requested by the Application is a rezone, a legislative item. The City Council has the authority to make the final determination regarding the application. The application is being presented to the City Council on August 8, 2023 as an informational item. The application is tentatively scheduled to be presented to the City Council on August 29, 2023 for a final decision.
