Amendments to the Board of Adjustment Rules of Procedure

Description/Background:
During the 2025 Utah Legislative Session, House Bill 368 was passed that included an amendment stating that the city “may not require a public hearing for a request for a variance or land use appeal.” To address this new provision in state law, amendments are proposed for the Board of Adjustment Rules and Procedures. There are also a couple of other changes included for consistency with the Sandy Land Development Code. All of these amendments are presented in the attached (red-lined) document.

Recommendation
Staff recommends the Board of Adjustment adopt amendments to the Rules of Procedure for consistency with state law and the city code.
