Description/Background:

Adam Nash (Applicant) has submitted an application for a zone change of two parcels, a total of approximately 2.5 acres, generally located at 348 E. 8000 S. from the IC Zone ("Institutional Care District") to the RM (12) Zone ("Residential Multi-Family District").  There is currently an occupied care facility on the property. The Application included a concept plan that depicts 20 single-family residential lots, a road through the proposed project accessing 8000 S., and a stub road to the west. The western property line is the boundary between Midvale City and Sandy City.

 

A neighborhood meeting was held on March 31, 2022.  As a legislative action, a zone change requires a public hearing with the Planning Commission and a decision to be made by the City Council.  A public hearing regarding this item was held by the Planning Commission on April 21, 2022.  The Planning Commission, by a vote of 6-0, approved a motion to forward a positive recommendation for the Application to the City Council.  The item was presented to the City Council for discussion on May 24, 2022

 

Fiscal Impact:

At the proposed density, it is likely that property tax revenues to the City from the proposed project would exceed expenses.

 

Further action to be taken:

If the rezone application is approved by the City Council, a subdivision and/or site plan application, both administrative items, would need to be submitted, reviewed by City staff, and approved by the Planning Commission before development could occur and building permits would need to be submitted, reviewed by City staff, and approved by City staff before houses could be built on the property.

2. Motion to Approve with revisions - Adopt Ordinance #22-06, an ordinance amending and fixing the boundaries of a zone district of the Sandy City Zoning Ordinance; rezoning approximately 2.5 acres, involving two parcels as proposed by the Applicant, generally located at 348 E. 8000 S. from the R-1-40A Zone ("Single Family Residential District") to the R-1-10 Zone ("Single Family Residential District") and the R-1-15 Zone ("Single Family Residential District"); subject to the following revisions: (expressed revisions).

 

3.
