Description/Background:

In 2022, Sandy City, to comply with changes to Utah Code by HB 462, adopted a Moderate Income Housing Element, including moderate income housing strategies and an implementation plan.  The adopted Moderate Income Housing Element included a total of six strategies, which is two more strategies than the minimum requirement.  Adopting the two additional strategies would qualify the City to be eligible to receive priority consideration when the City applies for certain State transportation funds.  The City is required to annually submit a moderate income housing report.  The 2022 requirements for submittal of the report was to include a description of the selected housing strategies and the associated implementation plan. The implementation plan adopted with the Moderate Income Housing Element identified the adopted strategies and actions items to implement those strategies. City staff submitted the City's implementation plan, as the required documentation for the 2022 Moderate Income Housing Report, to the Utah Department of Workforce Services in September 2022. 

 

The Department of Workforce Services reviewed the City's submittal and determined that the City's documents complied with the new minimum requirements adopted through HB 462, however they also determined that the City would not be eligible for the priority consideration when applying for the affected State transportation funds.  According to the Department of Workforce Services, the City was not eligible for priority consideration due to a lack of detail in the implementation plan for Strategy P (use of RDA moderate income housing set-aside funds).  City staff has since identified additional details that could be added to the implementation plan for Strategy P and determined to process a General Plan amendment (this item) with the intent to resolve the State's comments, and qualify for priority consideration for affected transportation funds.

 

The proposed a proposed amendment was presented to the Planning Commission on January 18, 2023.  The Planning Commission, by a vote of 6-0, forwarded a positive recommendation, recommending that the City Council approve the proposed General Plan amendment.

 

Fiscal Impact:

Not being eligible for the priority consideration created by HB 462, could potentially negatively affect City applications for certain State transportation funds.

 

Further action to be taken:

If approved by the City Council, documents the revised implementation plan will be resubmitted to the Department of Workforce Services for review.

Ordinance #23-01 (General Plan Amendment)

Staff recommends that the City Council approve Ordinance #23-01, amending the Sandy City General Plan by adopting the amendments to the Implementation Plan of the Moderate Income Housing Element.

 

Alternatives:

                     Approve Ordinance #23-01 with additional revisions.

                     Reject Ordinance #23-01, and provide suggestions to the Planning Commission for additional consideration.

                     Reject Ordinance #23-01.

 

Resolution #23-06C (2022 Moderate Income Housing Report)

Staff recommends that the City Council approve Resolution #23-06C, accepting the Sandy City 2022 Moderate Income Housing Report (amended) and authorizing submittal of the revised report to the State.

                     Approve Resolution #23-06C with additional revisions.

                     Reject Resolution #23-06C.
