Description/Background:
The applicant, Marc Cornelius, on behalf of the property owner, Bastow Family Limited Partnership, is requesting approval of a conditional use permit for increased size and height and a reduced side setback for a horse barn on a property located at 2048 E. Dimple Dell Rd. The proposed structure is 2,198 square feet, including a 631 square foot covered, unenclosed area, and 20 feet 7.5 inches in height. See application materials for details in Exhibit A (applicant letter) and Exhibit B (site plan and elevations).
A barn at this location was previously approved and construction began, but the work was abandoned for a period of time. The applicant has since resumed the project with a revised design that adds covered area, which requires conditional use permit review. The property was annexed into Sandy City in 2007 and an addition to the primary dwelling was permitted in 2023.
The subject property is approximately .93 acres (40,320 square feet) in the R-1-20(A) zone. Properties to the north, south, and west are single family residential zoned R-1-20(A). A private lane along the east side of the property is the current boundary between Sandy City and an unincorporated county island. The properties east of the lane, including an existing commercial horse stable, are a contiguous series of parcels under the same ownership as the subject property. The barn site is approximately 15 feet below the neighboring home to the south and 6 feet below the private lane to the east, which limits its visibility from surrounding properties.
Please see the attached staff report for full details of the request.
Recommended Action and/or Suggested Motion:
Recommendation
Staff recommends that the Planning Commission approve a conditional use permit for additional size, height, and a reduced side setback as described in the staff report for the property located at 2048 E. Dimple Dell Rd. based on the following findings and subject to the following conditions:
Findings:
1. The proposed structure is consistent with rear yard area coverage for accessory structures and with the increase allowed for “A” zoned lots under Section 21-11-2(a)(2).
2. The barn is in keeping with the agricultural character of the surrounding “A” zoned properties and is sited below the grade of the adjoining properties, which limits its visual impact.
3. Staff finds that the proposed structure meets the intent of Section 21-11-2 provided the applicant complies with the following conditions:
Conditions:
1. That the barn be located as per the enclosed site plan and be built to no more than 2,198 square feet and 20 feet 7.5 inches in height from finished grade to peak of roof, and no closer than 7.1 feet to the west side property line.
2. That the barn be used only for the personal keeping of horses owned by the property owner. No boarding of horses owned by others, lessons, or other commercial activity shall take place in the barn.
3. That the applicant complies with all Building & Safety, and Fire & Life Codes.
4. That the applicant be responsible for meeting all provisions of the Sandy City Development Code, and all conditions of approval imposed by the Planning Commission.
5. That this Conditional Use Permit be reviewed upon a legitimate complaint.
