Description/Background:

Utah Code Section 63N-23-104 requires a municipality to adopt a station area plan for all fixed guideway public transit stations located within the municipality’s boundaries and for any portion of the municipality located within a one-half mile radius from a fixed guideway public transit rail station located outside of the municipality’s boundary. According to Subsection (1)(b), the requirements to adopt a station area plan shall be considered satisfied if the municipality has already adopted plans or ordinances that substantially promote each of the objectives or the municipality determines that conditions exist that make satisfying the requirement for a station area plan impracticable.

 

Sandy City has a total of seven fixed-guideway public transit stations located in Sandy City or within a one-half mile radius of Sandy City's boundary. Sandy City has five approved station area plans, which were included in the City's update of the General Plan. Those plans have been certified by WFRC, as required. Utah Code requires station area plans or a waiver by way of a determination of impracticability for each station by the end of the year (2026). During the General Plan update, the two remaining stations (Kimballs Lane and Draper Town Center) were identified by the project team as potentially being eligible for a determination of impracticability, which would waive the requirement for a station area plan. WFRC requires that a resolution be approved by a municipality in making a determination of impracticability.

 

The portions of Sandy City within the one-half mile radius of the Kimballs Lane and Draper Town Center stations are similar. Both portions within Sandy City represent a minimal amount of the total station area and both are primarily built out as residential subdivisions. These established residential subdivisions are unlikely to redevelop within the foreseeable future. Canyons School District owns property (Sprucewood Elementary School) in the Draper Town Center Station area, however it was not identified as property that would be likely to disposed of by the School District any time soon. Besides road right of way, Sandy City owns three properties in the two station areas, a park (Eastridge Park), the hillside along the east side of 1300 E., and a detention pond. The detention pond was determined to be a potential opportunity area during the General Plan process as resizing of the pond could result in some developable property. The detention pond is also intersected by the one-half mile radius of the Crescent View Station area, and the potential redevelopment is addressed in the Crescent View Station Area Plan.  A determination could be made that existing conditions, the lack of vacant land available for developable and the lack of opportunities for redevelopment, make satisfying the requirement for a station area plan for these two areas impracticable.

 

Further action to be taken:

The item being presented on October 6, 2026 is for informational purposes. Resolution #26-92C, making a determination of impracticability, is scheduled to be presented to the City Council for action on October 13, 2026. If the resolution is approved, it would then be submitted to WFRC.
