Description/Background:

Dr. Glen Taylor, DDS, representing Hansen Property Investments whom was the property owner back in 2015, had requested to rezone approximately .29 acres from the R-1-8 “Single-Family Residential District” to the CN “Neighborhood Commercial District.” The subject property is located at approximately 675 East 9950 South. The intent of the rezone request was to allow for this property, along with the parcel to the north, to be redeveloped into a commercial site plan for a dental office. The northern property was already zoned CN and this would bring both properties under the same zone district.

 

This request went to the Planning Commission on May 7, 2015 and they forwarded a positive recommendation to the City Council. The City Council held the public meeting on June 9, 2015 and made the motion to bring the documents back to approve the rezone. However, staff neglected to bring this ordinance back to the Council. The ordinance was never adopted and thus the property has not been rezoned.

 

Under the presumption that the rezone was complete, the applicant continued to pursue the approvals needed to build the dental office under the CN Zone District requirements. The commercial site plan for this development was approved on March 21, 2016. A building permit was issued on March 31, 2016. The project was completed in April of 2017.

 

Staff is requesting the City Council to formally adopt the ordinance to change the zone district of this property to the CN “Neighborhood Commercial District” that a previous Council had approved back in 2015 and formally complete the rezone of this property and thus making the existing development legal and conforming to that zone district.

That the City Council adopt Ordinance 24-07, an ordinance amending and fixing the boundaries of a zone district of the Sandy City Zoning Ordinance; rezoning approximately .29 acres, involving one parcel, as proposed by the Applicant, generally located at 675 East 9950 South from the R-1-8 Zone ("Single-Family Residential District") to the CNZone (“Neighborhood Commercial District”).
