Description/Background:

Staff received a land use application on December 28, 2021, for a conditional use permit to allow for a “Mixed Use Development” in the Neighborhood Commercial (CN) Zone. The application indicates that they intend to build 196 residential units, 14,309 sq ft of retail/office space, and 11,523 sq ft of amenity areas. You can view the attached application materials for the conditional use permit.

 

Upon initial review of the request, city staff felt this fell short of meeting the standards in the code. Staff has been working with the applicant to improve their application. While the applicant has made a few changes since their initial submittal, staff concluded that their application failed to meet the code criteria for a mixed use development. Staff requested that the Planning Commission make the formal determination that their application (as it exists currently) did not constitute a mixed use development as defined in Sandy City Code. That interpretation request (see file MSC03202023-006505) was originally scheduled to go before the Planning Commission on April 20, 2023. After receiving our report and recommendation, the applicant asked for the item to be tabled. The applicant then pursued an opinion from the State Ombudsman’s Office. That review is still pending, and have not yet offered an opinion on the matter. The applicant requested for this interpretation question to be placed on the Planning Commission agenda. That meeting was held with the Planning Commission on August 3, 2023 (see the attached minutes). The Planning Commission did not come to a conclusive decision on the question, but did table the item. In the motion to table, it included direction to the applicant to go back and work with the surrounding land owners and GSBS to consult with them on the commercial area revitalization efforts with the General Plan, to develop a mixed use master plan that would be presented to the Planning Commission in a work session at a date mutually agreed upon by staff and the applicant.

 

Since that meeting, Staff held a neighborhood meeting on August 9, 2023. It was well attended, and we’ve also received many public comments on the matter. The minutes from that meeting and all written comments that staff has received are attached for further review.

 

The applicant has requested a work session with the Planning Commission. The applicant intends to present new information during the meeting. Staff has not reviewed any new information nor is aware of any changes to the information that was presented to the Planning Commission in August. Please reference the applicant's previously provided materials attached hereto. You can also reference previous staff analysis in related files (MSC03202023-006505).

 

The Chair has decided that the Planning Commission will take public comment at the conclusion of the work session discussion.

 

Further action to be taken:

As this item has been scheduled and noticed as a work session only, no formal action or decisions will be made during the meeting. In order for the Planning Commission to take formal action on the Conditional Use Permit application, it will require this item to return to the Planning Commission at a future date.
