Amendments to Title 21 of the Land Development Code related to Subdivision Review Standards

Description/Background:

On behalf of Sandy City, the Community Development Department is proposing to amend Title 21, Land Development Code, Chapter 30, Subdivision Review. The purpose of the code amendments are to update the standards for subdivision review procedures to bring the Land Development Code in line with recent changes to the Utah Code. These amendments have been reviewed by the Development Review Team, which is an interdepartmental group consisting of the Community Development, Public Works, Public Utilities, Parks and Recreation, Police, Fire and City Attorney Departments.

 

During the 2023 Utah Legislative Session, Senate Bill 174 and House Bill 406 were passed, which created new procedures that cities and counties must follow for subdividing residential property. SB 174 requires all local governments to update their subdivision ordinance; the deadline for Sandy City is February 1, 2024. SB 406 removes the requirement for a public meeting on property line adjustments. The impetus behind these new state regulations is to facilitate increased housing supply, by creating a uniform subdivision process statewide.

 

On December 14, 2023, the Planning Commission recommended the City Council adopt the proposed amendments to Title 21, of the Land Development Code, relating to Subdivision Review.

 

This item was discussed at the City Council work session on December 19, 2023. At that meeting, the City Council directed staff to limit amendments that only address Utah Code requirements. To that end, the proposed code amendments have been revised and the new proposal:

•  Updates the standards for subdivision review application requirements and procedures to align with new State Law requirements;

•  Matches current digital review practices;

•  Reorganizes and clarifies subdivision review requirements and procedures; and

•  Corrects errors where appropriate.

Recommended Action and/or Suggested Motion:

Recommendation

Planning Commission recommends the City Council adopt Ordinance 24-01 and amend Title 21, of the Sandy Municipal Code, relating to Subdivision Review as shown in Exhibit “A”, based on the following findings:

 

Findings:

 

1. The City Council may amend land use ordinances consistent with the purposes of the Sandy Land Development Code, the Sandy City General Plan, and the Utah Code, Municipal Land Use, Development, and Management Act per Title 21 Chapter 5 of the Sandy Municipal Code.

 

2. The proposal is reviewed by the Planning Commission and City Council in accordance with the requirements of Title 21 Chapter 5 of the Sandy Municipal Code.

 

3. The proposal complies with the purpose of the Land Development Code under Section 21-1-03 by promoting the public health, safety, and welfare; ensuring consistent and equitable standards; establishing fair procedures that are efficient and effective in terms of time and expense; and by facilitating the orderly growth and development of Sandy City.

 

4. The proposal complies with the Goals and Policies of the General Plan by establishing appropriate development standards for all uses and zoning categories within Sandy City.
