Description/Background:

Adam Nash of Land Development, LLC. (applicant) is requesting a change of zone district on property, approximately 1.78 acres, located at 9016 S. Riverside Drive from the CvC Zone ("Convenience Commercial District") to the PUD(12) Zone ("Planned Unit Development District"). The application was originally presented to the Planning Commission on May 16, 2024. The Planning Commission forwarded a recommendation to the City Council to deny the application. Prior to presenting the application to the City Council for a final decision, the applicant revised the concept plan, and presented the application to the Planning Commission on January 16, 2025, requesting that they reconsider their recommendation. The revised concept plan proposed the same number of units (19), but altered the way that access is provided to the site. The Planning Commission forwarded a positive recommendation. The application was presented to the City Council as an informational item on April 22, 2025.

 

Fiscal Impact:

It is Staff's opinion that, based on the concept plan, the fiscal impact of the proposed project to the City would be minimal.

 

Further action to be taken:

The action requested by the Application is a rezone, a legislative item, being presented to the City Council, as the final decision-maker, on April 22, 2025 as an informational item and on April 29, 2025 for action. If the rezone is approved, a separate application would be required to be submitted for review and approval of necessary improvements.

2. Motion to Approve with revisions - Adopt Ordinance #25-11, an ordinance amending and fixing the boundaries of a zone district of the Sandy City Zoning Ordinance; rezoning one parcel, approximately 1.78 acre, as proposed by the Applicant, generally located at 9016 S. Riverside Drive from the CvC Zone ("Planned Center-Convenience District") to the PUD(12) Zone ("Planned Unit Development"), subject to the following revisions: (expressed revisions).

 

3. Motion to Reject - Not adopt Ordinance #25-11, an ordinance amending and fixing the boundaries of a zone district of the Sandy City Zoning Ordinance; rezoning one parcel, approximately 1.78 acre, as proposed by the Applicant, generally located at 9016 S.
