Description/Background:

The applicant, Joseph Hansen, is requesting approval of a conditional use permit (CUP) for a property located at 10887 Prescott Dr. to construct a detached garage. The proposed single accessory building is 1,695.45 square feet in size and 12 feet 8.5 inches in peak height. Under Sec. 21-11-2(a)(2), single detached accessory structures exceeding 1,500 square feet require conditional use permit approval from the Planning Commission.

Recommended Action and/or Suggested Motion:

Recommendation

Staff recommends that the Planning Commission approve a conditional use permit for the detached garage as described in the staff report for the property located at 10887 S. Prescott Dr. based on the following findings and subject to the following conditions:

 

Findings:

1.                     The proposed 1,695.45 sq. ft. structure is consistent with rear yard coverage limits and overall lot development standards under Sec. 21-11-2(a)(2).

2.                     The structure satisfies the intent of Sec. 21-11-2 and Sec. 21-33-4, as the low 12-foot 8.5 inch flat-roof height and matching front stone veneer facade mitigate visual massing while establishing material compatibility with the primary dwelling.

3.                     No public comments opposing the proposal were received during the public notification process.

 

Conditions:

1.                     Approved Dimensions & Scope: The accessory garage shall have a maximum footprint of 1,695.45 square feet, an overall height not exceeding 12 feet 8.5 inches, and shall maintain a minimum 3-foot rear setback, as depicted in the approved plan set in Exhibit B.

2.                     Prohibited Uses: No portion of the structure shall be used for commercial business operations (unless authorized under a separate Category II Home Occupation CUP), nor finished and used as habitable living area (without separate approval).

3.                     Architectural Finish & Utility Restrictions: The front facade shall feature stone veneer matching the primary dwelling. In accordance with Sec. 21-11-2(a)(4)b, no separate utility meters (electric, gas, or water) may be installed for the accessory building.

4.                     Recorded Affidavit & Code Compliance: Prior to building permit issuance, the applicant shall execute and record a notarized Affidavit of No Extended Living Area / No ADU with the Salt Lake County Recorder's Office, and shall comply with all applicable Building, Safety, Fire, and Development codes.

5.                     Lighting & Drainage: Exterior lighting fixtures must be fully shielded and directed downward to prevent glare onto adjacent residential properties. All roof runoff must be retained on-site.

6.                     Complaint Review: This Conditional Use Permit shall be subject to administrative review upon receipt of a legitimate complaint.
