Description/Background:
This item originally came before the council for action on July 14, 2026. During that meeting a motion was made to adopt Ordinance 26-51...the motion resulted in a 3-3 tie and therefore failed. Per Council policy any motion may be renewed "if properly placed on the Council Meeting agenda." Once placed on the agenda, "any member may motion to rescind or amend an action of the Council."
Nathan Boyer, on behalf of The Boyer Company (applicant), is requesting a change of the future land use designation on one parcel, subject property, (7.2 acres) owned by the Canyons School District at 825 E. 9085 S. from the Institutional (IN) designation to the Medium Density Neighborhood (MN) designation. The subject property is currently used for the Canyons School District's C-Tech facilities. The applicant is seeking to redevelop the property as a townhome project. A separate application was also submitted to rezone the property.
A neighborhood meeting was held on May 18, 2026. The item was presented to the Planning Commission on June 4, 2026 in a public hearing. The Planning Commission forwarded a positive recommendation to the City Council by a vote of 7-0 (see attached minutes). The application was presented to the City Council as an informational item on July 7, 2026. The application was presented to the City Council for a decision on July 14, 2026. The application failed to be approved due to a tie vote of 3-3. The Council directed staff to prepare a development agreement to be prepared with the associated rezone and to bring back both applications at a future date. On September 15, 2026, both applications, with a development agreement, were presented to the City Council and both applications were denied. On October 15, 2026, City staff was informed that the rezone application was scheduled for reconsideration at the October 20, 2026 Council meeting.
In accordance with council policy on reconsideration and renewal of motions, "If properly placed on the Council Meeting agenda, any Member may Motion to Rescind or Amend an Action of the Council." Council Members Christensen and Stroud petitioned the chair to place this item back on the agenda so the council may consider amending its original action.
See the attached staff report for additional information on this request.
Further action to be taken:
The action requested by the Application is a general plan amendment, a legislative item, being presented to the City Council, as the final decision-maker, on October 20, 2026 for reconsideration of a decision.
See the attached staff report for additional information on this request.
