Description/Background:

Bob Kelez (Applicant) has submitted an application for a zone change of two parcels (approximately 2.0 acres) located at 590 E. and 606 E. 10600 S. (Property) from the R-1-20A Zone to the R-1-12 Zone (Proposal), both “Single Family Residential Districts.”  The Applicant originally requested a zone change to the R-1-6 Zone, but the Application was later amended to request a zone change to the R-1-12 Zone.  The Applicant's submittal includes a concept plan, revised per the amended zone requested, that would involve the removal of the two existing homes, both are accessed from 10600 S., and a potential subdivision that would include five lots on a new public street that intersects with 10600 S.   The average lot size depicted is 13,553 square feet (.31 acre).

 

The Applicant's original request was presented in a neighborhood meeting held on November 20, 2018.  It was after the neighborhood meeting that the Applicant amended the Application to request the R-1-12 Zone.  The Application was presented to the Planning Commission in a public hearing on January 17, 2019.  The Planning Commission, by a vote of 6-0, forwarded a recommendation to the City Council to not approve the Application.

 

Fiscal Impact:

A potential subdivision would likely increase the City's revenue and expenses by minimal amounts.

 

Further action to be taken:

The Application is requesting a rezone, a legislative item, and is being presented to the City Council for a decision to approve or deny the Proposal.  A separate application for a sudivision would need to be submitted and approved prior to development.

 

Recommended Action and/or Suggested Motion:

The Community Development Department recommends that the City Council take one of the following actions after hearing public comments:

1. Approve the Application.

2. Approve the Application with revisions.

3. Deny the Application.

4. Table the Application for a future decision.

1. Motion to Approve - Adopt Ordinance 19-??, an ordinance amending and fixing the boundaries of a zone district of the Sandy City Zoning Ordinance; rezoning approximately 2.0 acres located at 590 E. and 606 E. 10600 S. from the R-1-20A “Single Family Residential District” Zone to the R-1-12 “Single Family Residential Districts” Zone. 

2. Motion to Approve with revisions - Adopt Ordinance 19-??, an ordinance amending and fixing the boundaries of a zone district of the Sandy City Zoning Ordinance; subject to the following revisions: (expressed revisions) rezoning approximately 2.0 acres located at 590 E. and 606 E. 10600 S. from the  R-1-20A “Single Family Residential District” Zone to the R-1-12 “Single Family Residential Districts” Zone. 

3. Motion to Deny - Not adopt Ordinance 19-??, an ordinance amending and fixing the boundaries of a zone district of the Sandy City Zoning Ordinance; denying the proposed zone change of approximately 2.0 acres located at 590 E. and 606 E. 10600 S.

4. Table the Application - Table the application to a future decision. (If necesary, provide a date for further consideration and/or give direction to Staff for additional information requested.)
