Housing Updates-General Plan Amendment

Description/Background:

Earlier in 2019, the Utah Legislature approved Senate Bill 34 (SB34).  SB34 made revisions to Chapter 10-9a (Municipal Land Use, Development, and Management Act) of the Utah Code.  The changes largely affect the general plan requirements, particularly related to affordable housing.  SB34 also included a deadline of December 1, 2019 for cities to have a moderate income housing plan.  While Sandy City does already have a moderate income housing plan adopted as part of the Sandy City General Plan, the plan is not compliant with the revisions made by SB34. 

 

The proposed general plan amendment amends the City's current Housing Element, including the Moderate Income Housing Plan, of the Sandy City General Plan.  The intent is to comply with the revisions made by SB34 that affect the Housing Element and Moderate Income Housing Plan.  The proposal updates the City's housing information, analyzes the information, estimates housing needs and includes implementation strategies.  The implementation strategies may be the most significant change.  SB34 included a list of 23 implementation strategies.  Sandy City is required to select four of the strategies from the list.  The four selected strategies are included in Section 3 (Moderate Income Housing Plan) of the proposed revision to the Housing Element.  The proposed amendment does not revise any of the goals as included in the current Housing Element.

 

The proposed amendment was presented to the Planning Commission in a public hearing on November 7, 2019.  By a vote of 6-0, the Planning Commission forwarded a recommendation to the City Council to approve the proposed amendment.

Further action to be taken:

Utah Code (10-9a-404) requires that the Planning Commission hold a public hearing regarding the proposed amendment to the General Plan, and forward a recommendation to the legislative body (City Council).  The City Council may adopt, revise and adopt, or reject the a general plan amendment.

 

Recommended Action and/or Suggested Motion:

Staff recommends that the City Council approve Ordinance #19-29, amending the Housing Element of the Sandy City General Plan.

 

Alternatives:

                     Approve Ordinance #19-29 with additional revisions.

                     Reject Ordinance #19-29, and provide suggestions to the Planning Commission for additional consideration.

                     Reject Ordinance #19-29.
