Description/Background:

Utah Development Group (Applicant) has submitted an application for a zone change of a portion (approximately 0.62 acres) of a parcel (approximately 1.02 acres) located at 1368 E. Coppercreek Road from the Planned Center-Neighborhood District (CN Zone) and the Single Family Residential District (R-1-8 Zone) to the Residential Multi-Family District (RM(10) Zone.  The parcel is currently split-zoned, with approximately the western half designated the CN Zone and the other half designated the R-1-8 Zone.  The proposed rezone would include all of the area currently designated as the CN Zone (approximately 0.55 acres) and approximately 0.07 acres of the area currently designated as the R-1-8 Zone.  The remaining portion of the property (approximately 0.4 acres) is currently designated the R-1-8 Zone, and is proposed to remain zoned R-1-8. The Applicant has also submitted a concept plan that depicts the entire property. The concept plan shows 6 townhome units on the subject property and two single family homes on the remainder portion.

 

A neighborhood meeting was held on January 28, 2021.  The Planning Commission held a public hearing on February 18, 2021.  The Planning Commission approved a motion, by a vote of 4-2, to forward a recommendation to the City Council to approve the zone change to RM(10).

 

An application submitted in 2020 requesting a zone change to the RM(12) Zone for the entire property was denied by the City Council on September 22, 2020.

 

Fiscal Impact:

It is Staff's opinion that, based on the concept plan, that City revenues from the property would be approximately equivalent to City expenses for the property.

 

Further action to be taken:

The Application is requesting a rezone, a legislative item, and is being presented to the City Council for a decision to approve or deny the proposed zone change. If this rezone application is approved, subsequent subdivision/site plan applications and building permits would need to be approved prior to development and construction as proposed.

Coppercreek Road from the CN Zone "Planned Center-Neighborhood District" and the R-1-8 Zone "Single Family Residential District" to the RM(10) Zone "Residential Multi-Family District".

 

2. Motion to Approve with revisions - Adopt Ordinance #21-07, an ordinance amending and fixing the boundaries of a zone district of the Sandy City Zoning Ordinance; subject to the following revisions: (expressed revisions); rezoning approximately 0.62 acres of a 1.02 acre parcel located at 1368 E. Coppercreek Road from the CN Zone "Planned Center-Neighborhood District" and the R-1-8 Zone "Single Family Residential District" to the RM(10) Zone "Residential Multi-Family District".

Motion to Deny - Not adopt Ordinance #21-07, an ordinance amending and fixing the boundaries of a zone district of the Sandy City Zoning Ordinance; denying the proposed zone change of approximately 0.62 acres of a 1.02 acre parcel located at 1368 E. Coppercreek Road from the CN Zone "Planned Center-Neighborhood District" and the R-1-8 Zone "Single Family Residential District" to the RM(10) Zone "Residential Multi-Family District".
