Description/Background:

The Sandy City Public Works Department (Applicant) has submitted an application for a zone change of what will be a remnant parcel (approximately 0.09 acres) located on the east corner of the reconfigured intersection of 9270 S. and Benson Way from the PO Zone (Professional Office District) to the R-1-8 Zone (Single Family Residential District).  The application is associated with a City project to reconfigure 9270 S. to align with Rimando Way at State Street.  The intent of the application, if approved, would be to include the remnant parcel in a subdivision that would adjust the property lines of other residential properties also affected by the road realignment.

 

A neighborhood meeting was held on April 23, 2021.  The application was presented to the Planning Commission on May 6, 2021.  The Planning Commission, by a vote of 7-0, forwarded a recommendation that the City Council approve the zone change from the PO Zone to the R-1-8 Zone.

 

Fiscal Impact:

A zone change of the subject property may contribute to a subdivision that would include the remnant parcel and two existing residential lots that were purchased by the CIty to accommodate the road realignment.  The homes were demolished and those properties will be out of compliance with the zoning regulations due to the road project.   A subdivision could reestablish two lots that do comply with the zoning regulations.  The new lots could then be sold to recapture some of the project costs.

 

Further action to be taken:

A subdivision application and a street vacation application associated with the project have been submitted.  Those applications are being reviewed by City Staff and, pending the outcome of the rezone application, are expected to be processed for approval.

2. Motion to Approve with revisions - Adopt Ordinance #21-16, an ordinance amending and fixing the boundaries of a zone district of the Sandy City Zoning Ordinance; subject to the following revisions: (expressed revisions); rezoning approximately 0.09 acres of located at 9262 S. Benson Way from the PO Zone "Professional Office District" to the R-1-8 Zone "Single Family Residential District".

 

3. Motion to Deny - Not adopt Ordinance #21-16, an ordinance amending and fixing the boundaries of a zone district of the Sandy City Zoning Ordinance; denying the proposed zone change of approximately 0.09 acres of located at 9262 S. Benson Way from the PO Zone "Professional Office District" to the R-1-8 Zone "Single Family Residential District".
