Description/Background:
The applicant, Michelle Martin of Ford & Associates Architects, with permission from the property owners, Clark & Orfalea Investments, LLC, requests approval of a conditional use permit and a modified site plan for a property located at 10291 S. State St. The conditional use permit request is to allow for 24-hour operation of a veterinary office. The modified site plan request is for an outdoor pet relief area at the rear (east side) of the building in the Central Business District (CBD) zone.

Recommended Action and/or Suggested Motion:
Recommendation
Staff recommends that the Planning Commission determine a modified site plan review is complete for MedVet Emergency Hospital located at 10291 S. State St. based on the following findings and subject to the following conditions:
Findings:
1. The proposed project is consistent with previous approvals for site.
2. An outdoor pet relief area is properly located on the site and mitigated by the proposed and conditioned requirements.
Conditions:
1. That the applicant proceeds through the final site plan review process with staff. The Final Site Plan shall be in compliance with all Development Code requirements, staff redlines, and those modifications as required by the Planning Commission.
2. That the development comply with all Building & Safety, Fire and Life Safety Codes applicable to this type of use.
3. That necessary approvals for the outdoor pet relief area from the Jordan Basin Improvement District and the Jordan Basin Water Reclamation Facility are received.
4. That the lighting of the dumpster area must meet police approval.
5. That a fence be installed around the construction site to secure the area.
